How to avoid refusal and delay in UK Family Visa Applications including Spouse Visa, Fiance Visa, Dependent Children, Adult Dependent Relative?

Mitigate the delay in UK Spouse Visa, Fiance Visa and other family visa applications

Geting ready for UK Family Settlement Visa Applications

Family visa applications, including the UK Spouse Visa Application and UK Fiance Visa Applications, can be time-consuming to process. The UK Visas and Immigration (UKVI) may take longer to decide on complex visa applications. The processing time for family settlement visa applications varies between entry clearance applications and visa extension applications. During the COVID-19 period between 2021 and 2022, UKVI Premium Services (such as priority and super priority services) were temporarily suspended worldwide. However, these services have now been restored. As part of our service standard when representing a client’s UK visa application, we inform our clients about all available services at the time of application submission. This allows them to make an informed decision and choose the service that best suits their personal circumstances. Under normal circumstances, there is no way to expedite the visa application process unless exceptional and compelling circumstances exist. In the past, we have successfully requested fast-tracking of applications based on clients’ personal situations, and the Home Office visa officers have honored such requests on a case-by-case basis.

Effects of Refused UK Visa Applications

1. Families forced to live apart

Given the extended processing time for UK family settlement visa applications, it is crucial to be thoroughly prepared to minimize delays and prevent disappointment in case of application refusal after a three-month wait. Depending on the intricacy of the case and other factors (such as a fresh UK visa application or an appeal), family members may need to endure separation for eight months to one year. Ensuring meticulous preparation and understanding the nuances of the process can significantly impact the outcome.

2. Loss of Money- Β£2000- 10,000

A rejected visa application can result in significant costs, including:

  1. Non-Refundable UK Visa Fees: These fees can amount to thousands of pounds.
  2. Solicitor Fees for UK Visa Advice: Seeking professional advice for settlement applications incurs additional costs.
  3. Biometrics Appointment Fee: Charged by UKVI, VFS Global, or TLS Contact.
  4. TB Test for UK Visas: TB test reports are valid for 6 months.
  5. Approved English Language Test: English tests typically have a validity period of 2 years.

In certain situations, an expired English language test certificate (such as an approved test at CEFR Level B1) may be used more than once. For example, a test used for an ILR (Indefinite Leave to Remain) application could also be utilized in an application for British Nationality to naturalize as a British citizen.

For instance, when partners live apart, they must cover rent for both properties in different counties, as well as other bills. In contrast, when partners live together, they share living expenses.

Joining a partner as soon as possible also allows the joining spouse to contribute financially, easing the burden caused by high UK visa fees and the Immigration Health Surcharge (IHS). The IHS currently stands at Β£1035 per year for adults applying for UK family visas.

3. Loss of time 8 Months to 1 Year

In addition to the financial costs, time is of the essence when families are unable to reunite. This situation can lead to mental stress, anxiety, and financial strain, which in turn can impact the relationship between partners as a family unit.

4. Appeals are expensive

Appeals in the First Tier Tribunal can take months to years (especially during the recent pandemic) and cost thousands of pounds. Barrister and solicitor fees add to the expenses. However, even after investing significant time and money, there is no guarantee of a successful appeal. Therefore, it is crucial to prepare your visa application thoroughly from the outset to avoid disappointment.

Typically, immigration appeal fees range from Β£2500 to Β£4000, excluding barrister fees for court hearings.

5. Adverse Immigration history after a UK Visa Refusal

A refused UK visa application will create an adverse immigration history which is most likely to affect the future UK visa applications. Therefore it is very important that all UK visa applications are well presented and well prepreated to minimize the changes of getting refused.

Steps you can take to avoid refusal and delays in UK Family visa applications

When preparing your application:

  • 1. Provide as much relevant information as possible for the visa officer to understand your case.
    2. Avoid unnecessary information or document clutter, as it can cause delays or even refusal due to contradictions. Striking a balance between the minimum and maximum information is crucial.
    3. Ensure all requirements of the immigration rules are met. Be transparent and accurateβ€”do not hide or conceal any information.
    4. Use appropriate language and plausible explanations to address any potential issues.
Start collecting necessary information and documents well in advance (ideally 6 to 9 months before submitting the visa application). Ensure that documents are legible and follow the prescribed format. The UK Home Office has strict regulations on the required documents.
    6. Do not blindly follow the system generated list of documents as most of the time, the list is not exhaustive. The onus is on the applicant to provide all required documents and information.
    7. Documents not in English should be accompanied by Certified English Translation.
